YNS Subscription Service Terms & Conditions

By subscribing to the YNS Subscription Service (hereafter referred to as "Service"), you (hereafter referred to as "Subscriber") hereby acknowledge, accept, and agree to be bound by the following terms, conditions, provisions, policies, restrictions, and guidelines as stipulated herein. These Terms & Conditions (hereafter referred to as "Agreement") supersede any prior agreements, representations, or understandings, whether written or oral, related to the Service.

1. Definitions and Scope

1.1 Subscription Plans:

YNS offers tiered subscription plans ("Plans"), including but not limited to the following:

• Patience Plan: Weekly charge of $5

• Steady Path: Weekly charge of $20

• Ultimate Ink: Weekly charge of $50

1.2 Credits:

Credits refer to non-monetary, non-transferable points accumulated within the Subscriber’s account as determined by the Plan selected.

1.3 Subscription Fees:

The monetary amounts paid on a weekly basis as per the selected Plan, a portion of which may be retained by YNS as operational fees ("Fees") while the remainder is converted into Credits.

1.4 Benefits:

Includes but is not limited to flash tattoos, merchandise, discounts, priority booking, touch-up services, aftercare packages, and other perks exclusively provided at YNS’s discretion.

2. Credit Allocation and Fee Retention

2.1 Division of Subscription Fees:

Subscription Fees are allocated as follows:

• 70% of the fee is converted into Credits

• 30% of the fee is retained by YNS for administrative and operational purposes

2.2 Credit Redemption:

Credits may only be redeemed upon reaching or exceeding the following minimum thresholds:

• Patience Plan: $150 minimum credit balance

• Steady Path: $150 minimum credit balance

• Ultimate Ink: $150 minimum credit balance

In all cases, credits may only be redeemed if the Subscriber’s credit balance equals or exceeds the full cost of the tattoo or service being requested.

Redemption eligibility is further contingent upon continued compliance with this Agreement.

If a Subscriber elects to redeem Credits prior to reaching the required balance to cover the full cost of a tattoo or service, and opts to pay the remaining amount out-of-pocket, they may do so; however, by exercising this partial-credit redemption method, the Subscriber forfeits eligibility for any and all associated benefits, perks, or discounts offered within their current Subscription Plan for that appointment. Full benefit access remains strictly contingent upon full-credit redemption.

3. Conditional Access to Benefits

3.1 Flash Tattoos:

• Flash tattoos are offered once annually after 10 months on the plan under the Steady Path and Ultimate Ink Plans only.

• Flash tattoos are redeemable only if the Subscriber’s credit balance equals or exceeds the full value of the flash tattoo (e.g. $150 minimum).

• YNS reserves the right to limit flash tattoo designs to pre-approved flash sheets.

3.2 Merchandise:

• Merchandise, if offered, may only be redeemed after three (3) months of active subscription.

• Merchandise redemptions may not be combined with other benefits in a single appointment or transaction.

3.3 Discounts:

• Patience Plan: Eligible for 5% discount on first appointment

• Steady Path: Eligible for 10% discount on first appointment

• Ultimate Ink: Eligible for 15% discount on first appointment

All discounts may only be applied if the Subscriber’s credit balance is equal to or exceeds the full cost of the tattoo or service. Discounts cannot be redeemed when using partial credit and part cash.

3.4 Prohibition on Multiple Redemptions:

Flash tattoos, merchandise, discounts, touch-ups, and other benefits may not be redeemed simultaneously within the same transaction or booking. Separate appointments must be made to access each benefit individually.

3.5 Touch-Ups & Aftercare:

• Steady Path Subscribers are entitled to two (2) free touch-up sessions per calendar year.

• Ultimate Ink Subscribers are entitled to unlimited free touch-up sessions and one (1) aftercare package annually, provided such services are booked in accordance with YNS’s guidelines and are not due to negligence or failure to follow aftercare instructions.

• Patience Plan Subscribers are not entitled to complimentary touch-ups or aftercare.

4. Redemption Limitations

4.1 Redemption requests are subject to the following:

• All redemptions must be made in person at YNS

• Redemption requests must be submitted at least seven (7) business days prior to the intended date of use

• YNS reserves the right to approve or deny redemption requests at its sole discretion

5. Subscription Duration, Cancellations, and Refunds

5.1 Duration:

Subscriptions will continue indefinitely until explicitly canceled by the Subscriber or terminated by YNS.

5.2 Cancellation Policy:

• Cancellation requests must be submitted via the YNS Customer Support portal or via certified mail.

• Subscribers who cancel within three (3) months of initiating their Plan forfeit all accumulated Credits and benefits.

5.3 Refunds:

Subscription Fees are non-refundable under all circumstances, including but not limited to lack of use, dissatisfaction, or termination of the Agreement.

6. Priority Booking and Availability

6.1 Priority booking for Subscribers is subject to the following:

• Priority booking is provided based on artist availability. No guarantees are made regarding specific dates or times.

• Requests must be made via the YNS booking system, subject to a 14-day notice period.

7. Subscriber Obligations and Prohibited Conduct

7.1 Subscribers agree to:

• Maintain up-to-date payment information to avoid interruption in their subscription

• Use benefits solely for personal, non-commercial purposes

7.2 Subscribers shall not:

• Transfer or sell Credits, benefits, or subscription accounts to third parties

• Engage in fraudulent or abusive conduct, including but not limited to false redemption claims

8. Termination by YNS

8.1 YNS reserves the right to terminate any subscription for violations of this Agreement, fraudulent activity, or other misconduct. Termination under this clause results in the immediate forfeiture of all accumulated Credits and benefits.

9. Liability and Indemnity

9.1 YNS shall not be liable for:

• Loss of Credits due to termination or expiration

• Delays, cancellations, or rescheduling of appointments

• Adverse reactions or outcomes from tattoo services

9.2 Subscribers agree to indemnify and hold harmless YNS against any claims, damages, or liabilities arising from their subscription or use of services.

10. Amendments and Modifications

10.1 YNS reserves the right to amend this Agreement, subscription plans, benefits, and pricing at any time with a minimum of thirty (30) days’ notice to Subscribers.

10.2 Plan and System Modifications:

YNS reserves the right to modify, restructure, or discontinue any subscription Plan, credit system, or associated benefit structures at its sole discretion. Such changes may include, but are not limited to, renaming plans, altering weekly charges, changing credit conversion rates, or introducing/removing tiers. Subscribers will be provided with a minimum of thirty (30) days’ notice prior to any material changes. Continued use of the Service after such notice constitutes acceptance of the modified terms.

11. Governing Law and Jurisdiction

11.1 This Agreement is governed by the laws of QLD Australia. Any disputes shall be exclusively resolved in the courts of QLD Australia.
